Conditions of purchase:
These conditions are agreed upon by, on the one hand, the company DOÑA CARMEN and, on the other hand, persons who wish to make a purchase through the DOÑA CARMEN website, hereinafter referred to as "the user".
Orders will be shipped to mainland Spain, the Balearic Islands, except the Canary Islands, Ceuta and Melilla. Orders will also be shipped to mainland Portugal, France, Italy, Germany, United Kingdom, Austria, Belgium, Netherlands and Luxembourg. Islands are excluded.
These conditions refer exclusively to non-commercial individuales. The parties agree that their relationships will be governed exclusively by this contract. In the event of absence of a condition, it would be considered regulated by the practices and customs in force in the distance selling sector according to the rules of the professional code of the Association of Distance Selling.
These conditions are intended to define the terms of sale between DOÑA CARMEN and the user, including request of services, payment and delivery. These conditions regulate all the steps necessary to place and order and ensure the monitoring of said order for the Contracting Parties.
The user can place their order online. Size, color and desired quantity of products can be selected on the page of said product, and the selection can be added to the shopping cart.
Once all desired products have been selected, the user can consult their selection in the “My Cart” area.
If the user is satisfied with the selection, they can place the order by clicking on the “Complete order” button. At this time, the user’s payment and delivery information will be requested.
For the user, the act of placing the order is equivalent to full acceptance of prices, of the description of the products being sold and of the general conditions of purchase, which will be the only ones applied to the contract thus conclude. Any dispute regarding this last point will be settled with the possibility of a potential Exchange and the application of the guarantees detailed below. DOÑA CARMEN will process orders as long as the products are available. In the event of a lack of product availability, DOÑA CARMEN agrees to inform the user as soon as possible.
Orders will be delivered to the address indicated by the user upon placing their order or, in the case of in-store pickup, at the chosen store.They will be delivered to the selected store between 3/5 working days from your purchase. After sending your order you will receive an informative email and a few days later you will be contacted by phone from the store to inform you when your order is ready to collect. You have 30 calendar days from the date of purchase to pick it up. If you do not pick up your order, the products will return to our warehouse and we will give you a voucher for the same amount to use on the web (with no expiration date).
In the event of absence at the indicated domicile, the company hired to handle delivery will contact the user at the telephone number provided by the user in order to arrange delivery. If the maximum time for storage elapses, the package will be returned to Doña Carmen. Packages cannot be delivered to a post office. In the event of failure to deliver due to causes beyond Doña Carmen’s control, shipping costs will not be reimbursed to the user.
DONA CARMEN pledges to delivery ordered products as quickly as possible. Average delivery time is approximately 2/3 days to Spain and Portugal. For International shipments delivery time is approximately 5/6 days.
This does not mean that circumstances causing delay in delivery cannot occur, in which case the client will be notified as soon as possible.
The user, unless choosing the option of store pickup, must add the costs of processing the order to the final amount of their order. These additional charges are comprised of set costs for the costs of packaging and shipping:
Shipping to the Peninsula €3.95. Free shipping for purchases over €50.
Shipping to the Balearic Islands €7.
Shipping to mainland Portugal €3.95. Free shipping for purchases over €50.

The shipping cost is €10. If the order involves a customs process, the cost of the order will be borne by the customer.

The shipping cost is €15
United States, Canada, Mexico, Japan, South Korea.
The shipping cost is €55. If the order involves a customs process, the cost of the order will be borne by the customer.

Please note that all shipments outside the UE may be subject to Import Duty/Tax/VAT.
As we have no control over these charges and cannot predict what they may be, additional charges for customs clearance must be paid by the client. Such charges are not included in the purchase price of Doña Carmen products. We will not be responsible for the payment of any Import Duty /Tax /VAT under any circumstances.
In the event of products being sold out, the amount of the product will be refunded to the same method of payment used in placing the order.
4. METHODS OF PAYMENT
- Credit cards: Visa, Mastercard.
By clicking on "Authorize Payment" you are confirming that the credit card is yours or that you are the legitimate holder of the gift card or credit card. To minimize the risk of unauthorized access, your credit card details will be encrypted. Credit cards will be subject to checks and authorizations by the issuing entity, but if said entity does not authorize payment, we will not be responsible for any delay or non-delivery and we will not be able to formalize any contract with you.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due as set out in our Purchase conditions (3. shipping)
Prices must be understood in euros. They take into account the VAT applicable on the day of the order. Any change in the applicable VAT rate will be reflected in the prices of the products. The prices that will be applied are those in force at the time of validating the purchase, except in case of manifest error.
Prices may change at any time, but possible changes will not affect orders for which we have already sent you an Order Confirmation.
The company reserves the right to cancel the order if it contains products with wrong prices, such as the RRP € 0.
In orders destined for the Canary Islands, Ceuta and Melilla or non-EU countries, deliveries will be exempt from VAT, meaning the price that appears on the items is exempt from VAT.
In accordance with the provisions of article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of the articles will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at all times depending on the specific item in question. In orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT by application of the provisions of article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and duties in accordance with current regulations. in each of these territories.

Any product can be exchanged or refunded except when specified otherwise.
Transportation costs incurred by the exchange or return due to customer dissatisfaction are borne by the user.
If the exchange or return is due to an error by DOÑA CARMEN, DOÑA CARMEN will refund costs incurred by the return.
7b. WAIVER RIGHT
The buyer will have 30 days from the date of purchase to rescind the contract without penalty and without need to provide a reason.
Costs incurred by the return will be borne by the buyer. Under no circumstance will COD returns be accepted.
7c- REMINDER OF THE LEGAL WARRANTY
In accordance with the provisions of section m) of Article 97.1 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, consumers and users are informed of the existence, with respect to the goods and products purchased throughout this website, under the legally established terms, of a guarantee of conformity, of a legal nature, for a period of two years from the date of purchase and/or delivery.
It is understood that the goods and products are in conformity with the contract provided that (i) they comply with the description given and have the qualities presented on this website, (ii) they are suitable for the use given to which the goods or products of the same type are normally put to use for and (iii) they have the same quality and performance which usually, with regard to a good or product of the same type, the consumer and user can essentially expect from the product.
If any property or product does not conform to the contract, it must be brought to our attention within a maximum period of two months from the time you became aware of the reason for it on the following telephone number ((+34)942 333 580) or by sending us an e-mail to the following address (firstname.lastname@example.org).
The conservation and presentation of the document which accredits the sale is a necessary condition for making the legal guarantee effective.
Deficiencies caused by negligence, use or undue manipulation of the goods or products will not be considered as defects or faults, susceptible to activate the above-mentioned guarantee.

8. SIGNATURE AND PROOF
The user must register to make the purchase.
The online indication of the bank card number and the final validation of the order will constitute the proof of the order in accordance with the legal provisions and will allow the enforceability of the amounts that will appear in the order form.
This validation is valid as a signature and acceptance of all operations carried out on the website.
This website also allows the purchase through the guest purchase functionality. In this type of purchase, you will only be asked for the essential data to be able to process your order. Once the purchase process is completed, you will be offered the possibility to register as a user or continue as an unregistered user.
For all stages of access to the DOÑA CARMEN website, from placin the order to delivery or subsequent services, DOÑa Carmen only has an obligation of means.
The company DOÑA CARMEN excludes any guarantee or responsibility for inconveniences or damages inherent in the use of the Internet, in particular a break of service, an external intrusion or presence of a computer virus, or any event qualifying as force majeure by case law.
10. SECURE PAYMENT
At DOÑA CARMEN, we are committed to guaranteeing the security of our clients’ personal data. For this reason, for data collected online we use the SSL (Secure Socket Layer) protocol, which ensures high-level protection.
That way, all transactions and payments carried out on our website are strictly protected.
When your bank card number is requested while confirming your order, all data is processed in an encrypted manner and all associated information is encrypted. This guarantees the confidentiality and safety of your transactions.
11. Returns for CHRISTENING products
For all articles belonging to the "BAPTISM COLLECTION & ALTARS, CEREMONY" (dresses, rompers, bonnets, panties, baptismal towels), the period of time for their exchange will be limited ONLY and EXCLUSIVELY, without any type of exception, to the fourteen calendar days following to the arrival of the article in question to the customer.
Under the terms provided for by the law, the right to a refund of what has been paid, for every item purchased through our website, will only operate within fourteen calendar days from the date on which the items have been delivered to the customer
12. RETURNS OF DEFECTIVE ITEMS
In cases where it is considered that the product does not comply with the provisions of the contract at the time of delivery, you must contact us immediately at firstname.lastname@example.org providing the product data as well as the damage who suffers and if possible some photograph. Each order is thoroughly reviewed so that claims for defective products will not be addressed when it is appreciated that the garments have been used, manipulated or deteriorated.
We will proceed to examine the case and we will notify you by e-mail within a reasonable period of time if it is appropriate to return or replace it (if applicable).
It will be DOÑA CARMEN who determines the model for the collection or shipment of the defective product, so that the client does not have to incur a cost. We will not assume shipping costs incurred by the client without prior agreement with Doña Carmen.
