From TAMAR Y ARIMA, S.L. (from now on DOÑA CARMEN), with C.I.F. B-39619390, as owner of the Web Site www.donacarmen.com (which you can contact at César Llamazares 33, 39011, Santander, telephone number 942 900 016  and e-mail address info@donacarmen.es), we inform you of the following:

The data collected through the DOÑA CARMEN website, will be processed for the following purposes:

  • Manage and develop the registration on the Website.
  • Manage and develop the online purchase, when applicable.
  • To manage any communications, complaints, claims, etc., that may be submitted to Doña Carmen through its Customer Service or by any other means able to do so.

Confidentiality and Data Protection

Regarding the provisions of Law 15/1999, dated 13th December, on the Protection of Personal Data, Doña Carmen informs the user of the existence of an automated personal data file created by and for Doña Carmen under its responsibility, for the purpose of maintaining and managing the relationship with the User, as well as informational tasks. Upon acceptance of these general conditions, Doña Carmen will need to compile some essential data from the user in order to provide services and/or information.

Log of Files and Forms

Completing the registration form is required to access and enjoy certain services offered on the website or two receive requested information. Failure to provide the requested personal data or failure to accept the data protection policy results in the inability to be informed, subscribe, register or participate in any promotions for which personal data is requested.

According to the provisions of Law 15/1999, dated 13th December, on the Protection of Personal Data, we inform you that any personal data obtained as a result of registration as a user or as a result of completing the contact form, will be added to a file owned by Doña Carmen, having implemented the security measures established in Royal decree 1720/2007 dated 21st December.

Data Accuracy and Veracity

The user is the only person responsible for the accuracy and correction of the reported data, exempting Doña Carmen of any responsibility regarding this matter. In any case, users guarantee and vouch for the accuracy, validity and authenticity of the personal data provided and commit to keeping them updated. The user agrees to provide complete and correct information in the contact, registration or subscription form.

Doña Carmen does not guarantee the accuracy of the information produced externally and credited to another source, thereby it is also not responsible for hypothetical damages that may arise from the use of said information.

Doña Carmen reserves the right to update, modify or remove information contained in its website, including limiting or denying access to said information.

Doña Carmen is exempt from responsibility for any losses or damages incurred as a result of errors, defects or omissions in the information provided by Doña Carmen when such is provided by sources external to Doña Carmen.

Cookies

The website does not use cookies that enable the building of the user’s expenses and browsing profile, considering such physical files as information stored on the user’s terminal and serving to facilitate the user’s navigation while on the website.

In any case, the user is able to configure the browser so as to prevent the installation of these files.

Purposes

Doña Carmen’s purposes are the maintenance and management of the relationship with the user and to send them information on our products and services.

Minors

In the event that some of our services are specifically oriented toward minors, Doña Carmen will request the approval from parents or guardians for the collection of personal data or, where appropriate, the automated processing of the data.

Delivery

Orders will be delivered to the address indicated by the user upon placing their order or, in the case of in-store pickup, at the chosen store. In the event of absence at the indicated domicile, the company hired to handle delivery will contact the user at the telephone number provided by the user in order to arrange delivery. If the maximum time for storage elapses, the package will be returned to Doña Carmen. Packages cannot be delivered to a post office. In the event of failure to deliver due to causes beyond Doña Carmen’s control, shipping costs will not be reimbursed to the user.

Prices

All prices are VAT included and are net prices. Prices must be understood in euros. They take into account the VAT applicable to the day of the order. Any change in the applicable VAT rate will be reflected in the prices of the products. The prices that will be applied are those prevailing at the moment of validating the purchase, except in case of manifest error.The company reserves the right to cancel the order in case it contains products with erroneous prices, such as the PVP 0 €.

Waiver right

The buyer will have 30 days from the date of purchase to rescind the contract without penalty and without need to provide a reason. Costs incurred by the return will be borne by the buyer. Under no circumstance will COD returns be accepted.

4.- UPDATES AND CHANGES TO THE COOKIES POLICY

We inform you that our Cookies Policy may be modified at any time (especially taking into account new legislative or regulatory requirements or with the aim of adapting this policy to the instructions issued by the Spanish Data Protection Agency). When significant changes are made to this Cookies Policy, the user will be informed by means of an informative notice on the website.

order preparation

Once you have made the payment you will receive a purchase confirmation email and the order number (please check the spam folder if you have not received it).

Orders placed after 3:00 p.m. will be processed the next business day and their delivery time increases by 24 hours.

Your order will be in 3 different states depending on when it is.

Payment Accepted: The payment is made and is pending preparation.

Order in Picking: Your order is being prepared.

Shipped: Your order has left our warehouse. You will receive an email as soon as it leaves our warehouses

If any unforeseen event arises and it takes longer, we will contact you via email or telephone to inform you, in case you want to cancel the order.

We are human, we try as much as possible to receive your order within 2-4 working days after it has left our warehouse.

We do everything possible to deliver your order within the established times, although we cannot be held responsible for delays due to reasons beyond Doña Carmen's control or force majeure.

You have two options to receive your order: FREE in any of our stores or through courier at your address.

FREE, with availability of the package in a maximum of *72h in the Doña Carmen store that you indicate. Once the shipment is received at the selected store, they will call you by phone so that you can pick it up as soon as it suits you. If they can't contact you, we'll send you an email. And if another 30 days pass and you still haven't picked it up, it will be returned from the store to our warehouse. In this case, we would refund the amount of the order in the form of a web code to make a new purchase.

MRW *24-48h, which will be delivered to your home for €3.95. You could even pick it up at your nearest MRW agency if you select it when ordering. MRW does not guarantee delivery in a certain time slot, but the courier will do everything possible to deliver it to you the next day before 7:00 p.m.

For shipments to the Balearic Islands we use the company SEUR.

These terms may be higher during sales periods, Black Friday, Christmas or the beginning of the season.

Order tracking

Once your order has been shipped, you will receive an email with the tracking number so you can check where it is. If at the time of delivery there is no one to pick up the package, you will receive an SMS and a second attempt will be made in which the carrier will contact you through the telephone number indicated in the order. If in a second delivery attempt you were not able to receive the shipment either, it will remain at the destination MRW/NACEX agency for 15 days. Once this time has elapsed, the order would be returned to our warehouse. If this circumstance occurs, we will refund the amount of the purchase discounting €3.95 for shipping and return costs.

To the Balearic Islands its shipment is with Seur.

For international shipments, you will receive a tracking number from the company MBE or SEUR

International deliveries

International orders will be shipped through MBE or SEUR.

If your shipment is addressed to a country outside the European Union, it may be subject to duties, taxes or other charges due to local and/or customs laws. We will send your package through the DDU (Duties and taxes uppaid) incoterm, which means that Doña Carmen will be in charge of delivering it but we will not assume possible customs expenses or local taxes.

The person to whom the order is addressed will always be responsible for all customs costs associated with the importation of the order (even if it is rejected).

It is also possible that, for customs reasons, the order may be delayed.

Returns

If you wish to return an item within a period of 30 calendar days from the purchase date, you can do so in three ways:

1- in any of our stores presenting the proof of purchase that you will receive by email (check the spam folder to make sure you receive it).

2 - Pick up at home: Only available for returns from the peninsula. You can request home collection through our website within your personal area in the orders section. This service will cost €3.95, which will be deducted from the total amount of the refund.

Indicating name, order number and telephone or email, to be able to make the payment. This payment will be made in the same way in which the purchase was made.

The customer will be responsible for the cost of shipping the returned items, please note that if you decide to return the items to us postage due, we will be authorized to charge you for the expenses that we may incur.

The return of the item must be made with all the elements that accompany, including packaging, protective plastic and instructions if applicable.

The return of those products that are not in the same conditions in which you received them or that have been used beyond the mere opening of the product will not proceed.

For any change you must make a new order. All returns that we receive at our facilities will be paid in the same way in which they were made within a period not exceeding one week from the receipt of the merchandise.

Returns of products for BAPTISM

For all items in the "BAPTISM COLLECTION" (skirts, rompers, bonnets, panties, christening towels, bibs), the period for their change will be limited ONLY AND EXCLUSIVELY, without any exception, to fourteen calendar days following the the purchase date.

Under the terms provided by law, the right to reimbursement of what has been paid will only operate in the fourteen calendar days following the date of the order placed.

Returns of defective products

In cases where it is considered that the product does not comply with the provisions of the contract at the time of delivery, you must contact us immediately at info@donacarmen.es providing the product data as well as the damage who suffers and if possible some photograph. Each order is thoroughly reviewed so that claims for defective products will not be addressed when it is appreciated that the garments have been used, manipulated or deteriorated.

We will proceed to examine the case and we will notify you by e-mail within a reasonable period of time if it is appropriate to return or replace it (if applicable).

It will be DOÑA CARMEN who determines the model for the collection or shipment of the defective product, so that the client does not have to incur a cost. We will not assume shipping costs incurred by the client without prior agreement with Doña Carmen.

Terms and conditions for orders within Spain (Except Ceuta, Melilla and the Canary Islands), Portugal and the Balearic Islands.

Store purchase returns

If you need to make any change or return, you have 30 days from the date of purchase. To do this, you have to present us with the purchase ticket or the gift ticket.

We will exchange it for another item or if you prefer, we will give you a voucher without expiration (except tare). Try not to lose it because it is essential to present it for exchange.
